Newnan Artist-in-Residence Program Use Agreement

This agreement outlines the expectations of residency for the artist in residence at the Newnan Artist in Residence (Art Rez).

Art Rez encourages experimentation, development of new ideas, learning of new skills, and interaction with the community. Residency should be a time of rich exploration for the artist and the community.

Art Rez is desirous of having the artist in residence come to the Art Rez for the period of time agreed upon with Art Rez. The artist in residence will work as an independent contractor to promote the arts in Newnan, Georgia. The artist in residence is desirous of coming to the Art Rez premises for said purposes. Therefore, in consideration of the resources hereinafter mentioned and the covenants contained herein, the parties agree as follows:

 

  1. Term: The artist in residence will reside at said residence during the period of time agreed upon with Art Rez. Absences for a reason other than Art Rez endeavors must have prior consent from Art Rez in writing. The artist in residence will have reasonable access to and use of Art Rez facilities, which include one residence for the purpose of furthering his/her research, study, own projects, or as a retreat.

 

  1. Residence Access and Condition: Art Rez has the right of access to the artist in residence at any time with reasonable notice. Art Rez often has important visitors who we feel compelled to show around the facility and studio. Art Rez also gives tours to potential and existing funders of Art Rez. Art Rez will make a best effort to give the artist in residence notice of these visits, and will keep these visits brief. The artist in residence is invited to use the Art Rez in whatever way the artist in residence wishes in order to advance his/her work; however, the space must be returned to Art Rez in the same condition it was when assigned upon arrival. Permanent changes and alterations such as painting surfaces or putting large holes in the walls are not permitted. The artist in residence will keep and maintain the Art Rez and appurtenances in good and sanitary condition during the term of this agreement.

 

  1. Housing: The artist in residence will be provided a fully furnished living space during their residency. It must be left in the same condition as it was assigned upon arrival.

 

  1. Guest Policy: During the residency, the artist in residence may have guests stay with them. The artist in residence is responsible for all food, expenses, damages that their guests incur during their stay.

 

  1. Respective Property of the Parties: The creative work and efforts of the artist in residence shall be and remain the property of the artist in residence. The cost of shipping work to the artist in residence’s home or studio is his/her responsibility at the conclusion of the residency. However, any documentation by audio/visual and photographic processes of the activities of the artist in residence while in residence shall remain the property of Art Rez. The artist in residence agrees to allow reproduction of said documentation for Art Rez’s promotional materials, at Art Rez expense. The artist in residence will also donate one piece of art work, chosen jointly by the board of directors and the artist, given to Art Rez for its permanent collection.

 

  1. Art Sales Policy and Procedures: Sales of any work belong to or created at Art Rez by the artist in residence is encouraged. The Art Rez may request a donation of 20% of sales, with the remaining proceeds going directly to the artist in residence.

 

  1. Hold Harmless: The artist in residence agrees to hold the Art Rez harmless for any damage or loss paid by or on its behalf on account or due to the artist in residence’s intentional or negligent conduct which causes loss or injury to another. IN WITNESS WHEREOF, the parties have hereunto set their hands on the dates indicated.

 

  1. Independent Guest: During the visit to Art Rez and the state of Georgia, the artist in residence is an independent guest. The artist in residence agrees to be responsible for his or her own actions as they pertain to the local community and state and federal laws and regulations.

 

  1. Community Involvement: Art Rez is located in Newnan, Georgia, providing artists and the community with access to each other. The artist in residence is encouraged to attend and participate in all Art Rez events, programs, etc. Art Rez board members will also bring guests to these events. Art Rez believes these events help to foster a sense of community among the artists and are an avenue for connecting with the public. In addition to open studio visits, the artists have the opportunity to voluntarily participate in Art Rez’s programs offered in local facilities.

 

  1. Medical Awareness: The artist in residence is responsible for informing Art Rez of any serious or life threatening medical conditions and any medications taken regularly. Should the artist in residence have any specific medical requirements, any special arrangements must be discussed in advance of the residency with the board of directors.

 

  1. Code of Conduct: During the residency, the artist in residence agrees to respect the Art Rez facilities. The artist in residence is expected to conduct him/herself in an appropriate manner.

 

While Art Rez anticipates that all artists in residence will conduct themselves in a mature and generous way, it is the individual artist’s responsibility to immediately report any incident or allegation to the board of directors. Art Rez’s board of directors has the responsibility of investigating and resolving complaints.

Art Rez reserves the right to terminate a residency if there is an indication that an artist in residence’s behavior will or does jeopardize the quality of the experience for other artists in residence, collaborations with sponsoring organizations and community relations.

 

  1. Insurance: Art Rez does not carry health insurance, personal injury or theft insurance for its artists in residence and should the artist in residence desire this coverage he/she will need to obtain it personally.

 

  1. Publicity and Promotion: Art Rez will promote artist in residence presentations and any other community interactions or projects he/she participates in during a residency. Please let Art Rez know if the artist in residence is planning any public exhibition/event/performances of work elsewhere during the time of the residency so Art Rez can mention them in press releases.

 

  1. Acknowledgement: It is required that any work which receives support for its development from Art Rez and appears in public performances must acknowledge Art Rez.

 

  1. Equal Opportunity: It is the policy of Art Rez that there shall be no discrimination with respect to selection of the artist in residence because of race, color, sexual orientation, religion, national origin, gender, age, physical limitations or military status.

 

  1. Background Search: By signature below the artist in residence agrees to allow the Art Rez to do a background search including a criminal history search.

 

By executing this agreement of confirmation of residency, any accepted artists in residence agree that neither Art Rez, nor any of its officers, directors, volunteers will be liable for any damages arising from personal injuries sustained by the artist in residence or guests on or about Art Rez premises as a result of using the facilities and any equipment, services, food or other provisions, and further agree that neither Art Rez, nor any of its officers, directors, volunteers shall be liable for any loss or theft of personal property. The artist in residence also agrees to abide by Art Rez rules and policies.
